SAN FERNANDO CITY, La Union – State prosecutors in Abra are being asked to be removed from the multiple murder cases against La Paz town mayor Joseph Bernos and his father –Danglas vice mayor Andres Bernos.
The National Bureau of Investigation-Cordillera on Tuesday noon asked the Regional State Prosecutor here to order the Abra provincial prosecutor’s recusal from the case, citing the latter’s “snail-paced” action.
Abra prosecutors have been accused of “sitting on” the statement of elf-confessed Abra assassin Jacobo Badua, delaying justice for at least three killings linked to the influential Bernos clan in the province.
Up to now, Abra provincial fiscal Nestor Tolentino, who has kept mum, has not assigned any investigating fiscal to conduct a preliminary investigation on the multiple murder suit filed on July 19, said NBI-Cordillera special investigator III Abner Dotimas.
“(We) feel that the NBI could not obtain a fair and impartial resolution of the case,” said Dotimas.
Badua narrated to the NBI how he was ordered to kill at least two villagers and saw how another assassin gunned down another, all upon orders of Mayor Bernos and vice mayor Bernos.
Badua’s family members have fled Abra.
“Worrisome Web Of Influence And Power”
Badua’s wife Loida is a public school teacher in Danglas town, where Mayor Bernos’ mother and Vice Mayor’s wife– Esther– is the town mayor.
Vice-mayor Bernos is the father of slain La Paz mayor Marc Ysrael, husband of incumbent Abra Rep. Ma Jocelyn Bernos. Ysrael was gunned down right in their hometown in 2006.
Rep. Bernos though has remained silent on the issue. Her father Bangued town mayor Dominic Valera, has also not addressed the issue.
Mayor Valera and the Bernoses are Liberal Party members. Pidigan town Mayor Jannsen Valera is also a member of LP.
Vice Mayor Bernos was Abra vice governor from 1984-86, then became a governor by succession. He was also mayor of La Paz and Danglas for four decades.
The Bernoses however said Badua’s allegations were all fabricated to get back at them because of the whistle blower’s political losses, among other things. According to Mayor Bernos, Badua is facing a murder charge and other criminal cases in the past. (Philstar.com)

I could now safely predict that these father and son will find their way to Camp Bagong Diwa detention cell while undergoing trial.

Let just give the Bernoses the chance to prove their innocence. This is similar to the case of Vicsyd they will get to be imprisoned while undergoing trial.

And even in the event that the fiscal should decide to dismiss the cases, the NBI and the complainant can always go to directly to the DOJ to seek relief. Let us not worry too much about Judge Corpus Alzate. He has been given a final warning by the Supreme Court to shape up. If anybody feels that Judge Alzate has not been fair in his decisions, he can always go to the Supreme Court Administrator to file a complaint. The best thing to do right now is to be vigilant and let the fiscals and judges in Abra know that we are watching them. The way to end evil is to fight it.

I believe that the main reason why most of them are still rendering unfavorable judgment or lack of balls and resisting to do the right thing and prepare to receive bribe instead because they are not stupid enough to discern that their life or the life of their loved ones are at stake. Due to false high pride (or shit) or lack of constitutional mandate, they are perhaps ashamed to ask the said protection or just happy to continue selling their souls to the devil for an exchange of wealth that temporarily satisfy their wants but surely do more harm than good for them and their loved ones/heirs, permanently. In view of this, Sir Pet, I do appreciate it very much if you could initiate (owning to your exemplary knowledge of the intricacies of law and journalistic talents exemplified by your above average or high IQ) to prepare a formal letter-request to the President or DOJ Secretary in considering this humble thought. The government fund to be used on this venture by recruiting/reassigning more Marines as their bodyguards might be lot cheaper than the amount to be recovered/prevented from corruption or the price of precious LIVES to be saved in the long run. Don’t tell/ask me Eric Shawn that “why not the PAGS of Abra to be used instead, so that our politicians will be devoid of bodyguards?”. Please tell him Sir Pet that I am not kidding but deadly serious for the realization of the CHANGE we had waiting for, hence, this humble suggestion that might be of help. Otherwise, I am willing to accept humiliation or to be ridiculed if they couldn’t just ignore it if it doesn’t suit their level of understanding/intelligence. Come on, I am waiting…….

But with all due respect, I do not have the personality to request the president or the justice secretary to provide security to our fiscals and judges. If any such request is to be made, it must come from the fiscals and judges themselves if indeed they feel threatened. I am not sure if these fiscals and judges in our province really want added security. I am sorry to say this but the reputation of many of our fiscals and judges does not inspire confidence in the justice system. It seems the color of money has tainted their collective conscience. Take a close look particularly at Judge Corpus Alzate and Provincial Prosecutor Nestor Tolentino and weep. The lady of justice is blindfolded to show fairness. But cases in the hands of judges and fiscals who are less than honest are decided in favor of the moneyed and powerful. The move of the NBI in asking for the inhibition of all judges and fiscals in the province of Abra is a slap on their collective faces. The action taken by the NBI says it all. They have for all intents and purposes passed judgment on the judges and fiscals in our province. Genuine change must start with all of us and that includes judges, fiscals, other government officials and personnel, the PNP and the military and the private sector too. We cannot institute change by ourselves. It has to be a collective effort by all Abrenos. For instance, if a person is threatened or feels threatened, he must file the complaint himself. I can only give people my humble advice but I cannot do everything for them, especially in cases where I have no personal knowledge or in cases where I do not have the legal personality. A concrete example would be the RTC branch I judge who signed the warrant of arrest of ex-Mayor Ryan Luna. That judge was afraid for his life too, but that did not deter him from doing what was right. The imminent threat on his life did not prevent him from performing his sworn duty. After issuing the warrant of arrest, he made himself scarce and reported the threat on his life to the proper authorities. It is normal to experience fear but to allow fear to grab you by the tail and wag you every which way, aah, that is something else. Striking fear in the minds and hearts of Abrenos is the single biggest weapon of tyrants in our province. If we do not succumb to fear, then half the battle is won. Look back to the recent past and tell me how courageous and brave the Lunas’ are. Guilty people run even when no one is pursuing but the innocent is as brave as a lion. There are about 300,000 Abrenos. Do you honestly believe that all the tyrants in Abra combined can kill all of us? It has been a mind game from the very beginning. We only get more of the same behavior that we tolerate. Don’t worry, my friend. The winds of change have come. I can feel it and I can sense it. People like you and countless others give hope that genuine change is just around the corner. Let us remain steadfast, let us remain vigilant. Let us not allow leader wannabees to lead us down the wrong road.

So, they don’t really have any excuse of not doing their job in accordance with their sworn duties? If I may conclude then, that, no matter what the honest President does in achieving the success of his “Matuwid Na Daan” nothing will happen if these blood-sucking children of the devil particularly the corrupt COA personnel/officers and judges/fiscals (just the corrupt, shut up if you are not) continue to mock/disrespect our judicial system that sabotage of what he had already started?
Well, we might as well continue to pray that the President will exercise his political will in the most strongest way and straighten his iron fist NOW than later or never in pulverizing the stinking balls of these agents of destruction or stumbling blocks of our journey towards “Matuwid Na Daan”.
The whole world is still watching us Mr. President, that if you fail in pulverizing corruption, perceived to be the main cause of poverty or miserable life, all the fruits of your hardships will all be just forgotten by the majority with emptied stomach. Appoint Sen. Lacson and Trillanes if you must in annihilating these wicked corrupt government thieves for it seems that they alone have the balls in doing the job.
